"The Frankfurt Auschwitz trial was a milestone event in West German history. Between 1963 and 1965, former Auschwitz personnel were tried in Frankfurt am Main. It was a Holocaust perpetrator trial that saw the engagement of four of the nation's leading historians as expert witnesses - Martin Broszat, Hans Buchheim, Helmut Krausnick, and Hans-Adolf Jacobsen - appointed by the prosecution to give evidence pertaining to the historical and organisational context of the alleged crimes. Following the trial, the reports of these historians were published in a bestselling book, Anatomie des SS-Staates (Anatomy of the SS State). Mathew Turner here investigates the relationship between the trial and this publication. In recent years, more attention has been paid to the intersection between history and law that accompanies historians' entry into the courtroom. Very little, however, has been written about this intersection with a focus on a single case study. Abstract

In The Right to Be Present at Trial in International Criminal Law Caleb H. Wheeler analyses what it means for the accused to be present during international criminal trials and how that meaning has changed. This book also examines the impact that absence from trial can have on the fair trial rights of the accused and whether those rights can be upheld outside of the accused’s presence. Using primary and secondary sources, Caleb Wheeler has identified four different categories of absence and how each affects the right to be present. This permits a more nuanced understanding of how the right to be present is understood in international criminal law and how it may develop in the future.

Abstract

This book includes an analysis of the Jehoash Inscription Tablet, which describes renovations made to the First Temple and is considered the only written evidence of its existence. At the same time, a new technique for authenticating artifacts is described: this is especially important in determining the authenticity of artifacts collected from unprovenanced sites. Other subjects treated in the book are: the only known stone oil lamp with שבעת המינים carved onto seven nozzles, which was archaeometrically analyzed to verify its authenticity, and is thought to have been used during the Second Temple Period in rituals that necessitated that laws of purity be followed; and the James Ossuary, displaying the Aramaic inscription Ya'akov bar-Yosef akhui diYeshua (James, son of Joseph, brother of Jesus), which, if genuine, might provide archaeological evidence for Jesus of Nazareth and indicate that the ossuary was that of James the Just, the older brother of Jesus.

Abstract

While international efforts in the development of short rotation woody crops (SRWCs) have historically focused on the production of biomass for bioenergy, biofuels, and bioproducts, research and deployment over the past decade has expanded to include broader objectives of achieving multiple ecosystem services. In particular, silvicultural prescriptions developed for SRWCs have been refined to include woody crop production systems for environmental benefits such as carbon sequestration, water quality and quantity, and soil health. In addition, current systems have been expanded beyond traditional fiber production to other environmental technologies that incorporate SRWCs as vital components for phytotechnologies, urban afforestation, ecological restoration, and mine reclamation. Abstract

The complicated relationship between defendants with mental health disorders and the criminal justice system The American criminal justice system is based on the bedrock principles of fairness and justice for all. In striving to ensure that all criminal defendants are treated equally under the law, it endeavors to handle similar cases in similar fashion, attempting to apply rules and procedures even-handedly regardless of a defendant’s social class, race, ethnicity, or gender. Yet, the criminal justice system has also recognized exceptions when special circumstances underlie a defendant’s behavior or are likely to skew the defendant’s trial. One of the most controversial set of exceptions –often poorly articulated and inconsistently applied – involves criminal defendants with a mental disorder. A series of special rules and procedures has evolved over the centuries, often without fanfare and even today with little systematic examination, that lawyers and judges apply to cases involving defendants with a mental disorder. This book provides an analysis of the key issues in this dynamic interplay between individuals with a mental disorder and the criminal justice system. The volume identifies the various stages of criminal justice proceedings when the mental status of a defendant may be relevant, associated legal and policy issues, the history and evolution of these issues, and how they are currently resolved. To assist this exploration, the text also offers an overview of mental disorders, their relevance to criminal proceedings, how forensic mental health assessments are conducted and employed during these proceedings, and their application to competency and responsibility determinations. In sum, this book provides an important resource for students and scholars with an interest in mental health, law, and criminal justice.

Abstract

The purpose of this Special Issue is to provide a thorough and up-to-date presentation of research investigating the impact of coffee and/or caffeine intake on various health outcomes. Areas of interest include, but are not limited to, the following topics: Human clinical trials of coffee or caffeine use in relation to disease or intermediate phenotypes. Abstract

Una de las discusiones que perdura desde el fin de la última dictadura militar en la Argentina es la que se refiere a la naturaleza criminal de los actos perpetrados desde el Estado en aquel período. Motivado por responder a ese interrogante, Martín Lozada ofrece un recorrido analítico que va desde el derecho penal internacional a la especificidad del debate local. En la primera parte de este libro, el autor evalúa las características del complejo de los crímenes contra la humanidad y, particularmente, de los crímenes de lesa humanidad y genocidio. Para ello, no solo indaga en la conformación técnico-jurídica de estas figuras, sino que busca explicitar, más allá de la propia letra de la ley, qué tragedias humanas exigieron su construcción teórica. En la segunda parte se aboca al caso argentino: «se suele invocar el carácter genocida de los actos perpetrados por los entonces detentadores del poder del Estado, usurpado mediante las maniobras pergeñadas y concretadas por el poder militar –y sus colaboradores civiles– a partir del día 24 de marzo de 1976.
